EXPLANATION FOR APPLICANTS

Only complete this APPLICATION if You are sure that You want to enter into a Residential Tenancy Agreement with the Lessor of the Premises

The Lessor of the Premises is attempting to locate the most suitable tenant; that is a tenant who pays the rent on time and takes good care of the Premises.

To enable the Lessor of the Premises to determine in their opinion, who is the most suitable person, the Lessor's Property Manager requires some background information about You.

The form "APPLICATION TO ENTER INTO RESIDENTIAL TENANCY AGREEMENT" is not the Residential Tenancy Agreement.

The purpose of this form is:

First, to inform the Lessor of Your details, and Your requirements for the Residential Tenancy Agreement; for example, if You wish to have pets at the Premises.

Second, to inform You of the Lessor's or Property Manager's usual use of one or more residential tenancy databases.

Third, to inform You of the money that is required to be paid prior to taking possession of the Premises; for example, the value of the Security Bond (which may be up to 4 weeks rent), the Pet Bond (which can be up to $260) and the initial Rent payment (which can be 2 weeks rent in advance).

Fourth, to make You aware of the terms of the Residential Tenancy Agreement (including special conditions) associated with the Lease if Your Application is accepted.

Your Questions, Answered

What is the purpose of the Reiwa Tenancy Application form?

The Reiwa Tenancy Application form is designed for individuals who wish to apply for a Residential Tenancy Agreement. It collects essential information about the applicant to help the Lessor determine their suitability as a tenant. This includes personal details, rental requirements, and any special conditions, such as the desire to have pets.

What information do I need to provide on the application?

Applicants must provide personal details, such as their name and contact information, as well as specifics about their tenancy needs. This includes the desired rental period, the number of occupants, and any pets. Additionally, applicants may need to disclose their financial situation, including bank account details for potential refunds.

What happens after I submit my application?

Once you submit your application along with any required Option Fee, the Property Manager will review it. If you are not selected, any Option Fee paid will be refunded within seven days. If you are successful, you will receive a proposed Residential Tenancy Agreement, which you must sign to finalize the lease.

What is an Option Fee, and when is it required?

The Option Fee is a payment made to secure the opportunity to enter into a tenancy agreement. It is required at the time of application if specified. The amount varies based on the weekly rent and can be refunded or applied toward rent if you become the successful applicant.

What are the financial obligations if my application is accepted?

If accepted, you will need to pay a security bond, a pet bond (if applicable), and the first two weeks' rent. The total amount due will be outlined in the proposed Residential Tenancy Agreement. If an Option Fee was paid, it will be deducted from this total.

Can I request special conditions in my application?

Yes, you can include any special conditions in your application. However, it is important to understand that the Lessor is not obligated to accept these conditions. They will consider them during the review process.

What if I change my mind after submitting the application?

If you change your mind after submitting your application, it is advisable to inform the Property Manager as soon as possible. However, any Option Fee paid may not be refundable if you withdraw your application after it has been processed.

How does the Lessor use my personal information?

The Lessor uses the personal information provided in your application to verify your identity, assess your suitability as a tenant, and manage the tenancy if your application is successful. This information may be shared with third parties, including tenancy databases, for verification purposes.

What are the consequences if I do not comply with the agreement terms?

If you do not comply with the terms of the Residential Tenancy Agreement, including signing the agreement or paying the required fees, the agreement may not be binding. This could result in the Lessor leasing the property to another applicant, and any Option Fee may be forfeited.

Common mistakes

  1. Incomplete Personal Information: Many applicants fail to provide all necessary personal details, such as full names, contact information, and identification numbers. This can delay the processing of the application.

  2. Neglecting to Specify Tenancy Requirements: Some applicants do not clearly state their rental requirements, such as the desired duration of the lease or the number of occupants. This omission can lead to misunderstandings later.

  3. Ignoring Special Conditions: Applicants often overlook the section for special conditions. If there are specific requests, such as pet allowances, they should be explicitly mentioned to avoid issues.

  4. Incorrect Financial Information: Providing inaccurate financial details, such as the wrong amount for the option fee or security bond, can result in complications. It is crucial to double-check these figures before submission.

  5. Failure to Acknowledge Terms: Some applicants do not fully read or understand the terms outlined in the application. This can lead to issues later, especially regarding the obligations of both parties.

  6. Not Providing Bank Details: When required, failing to include bank account details for the refund of the option fee can cause delays in processing. This information is essential for the property manager.

Documents used along the form

When applying for a tenancy, several additional documents may be required alongside the Reiwa Tenancy Application form. These documents help establish eligibility and clarify the terms of the tenancy. Below is a list of common forms and documents that are often used in conjunction with the application.

  • Proof of Identity: This document verifies the applicant's identity. Common forms include a driver's license, passport, or state-issued ID.
  • Income Verification: Applicants may need to provide recent pay stubs, tax returns, or bank statements to demonstrate their ability to pay rent.
  • Rental History: A document outlining previous rental experiences, including contact information for past landlords. This helps the lessor assess the applicant's reliability as a tenant.
  • Credit Report: A report that shows the applicant's credit history. It helps the lessor evaluate the financial responsibility of the applicant.
  • Pet Application: If applicable, this document provides details about any pets the applicant intends to bring. It may include information on breed, size, and behavior.
  • Reference Letters: Letters from previous landlords, employers, or personal contacts that speak to the applicant's character and reliability.
  • Special Conditions Request: A document outlining any specific requests the applicant has regarding the tenancy, such as modifications to the property or specific lease terms.

These documents assist in the thorough evaluation of the tenancy application. Providing complete and accurate information can help streamline the application process and improve the chances of securing the desired rental property.

Similar forms

The Rental Application Form is quite similar to the Reiwa Tenancy Application Form. Both documents serve as a preliminary step for prospective tenants to express their interest in renting a property. They require applicants to provide personal details, including their rental history and financial status. The Rental Application Form also includes sections for references, allowing landlords to assess the applicant's reliability as a tenant. In essence, both forms aim to gather essential information that helps landlords make informed decisions about potential tenants.

The Lease Agreement is another document closely related to the Reiwa Tenancy Application Form. Once an application is approved, the Lease Agreement outlines the terms and conditions of the rental arrangement. It includes critical information such as the duration of the lease, rent amount, and responsibilities of both the tenant and landlord. While the Reiwa form focuses on the application process, the Lease Agreement formalizes the relationship between the tenant and the landlord, making it legally binding.

The Pet Application Form is similar as it specifically addresses tenants who wish to bring pets into a rental property. Like the Reiwa Tenancy Application Form, it collects information about the type of pet, breed, and any special requirements. This form is essential for landlords to evaluate whether they are comfortable allowing pets in their properties, ensuring that all parties understand the conditions surrounding pet ownership during the tenancy.

The Background Check Authorization Form is also akin to the Reiwa Tenancy Application Form. This document gives landlords permission to conduct background checks on potential tenants. It typically includes consent for credit checks and verification of rental history. Similar to the Reiwa form, it seeks to provide landlords with a comprehensive view of the applicant’s background, helping them assess the applicant's suitability as a tenant.

The Security Deposit Agreement is another document that shares similarities with the Reiwa Tenancy Application Form. This agreement outlines the amount of the security deposit required and the conditions under which it will be returned. Both documents emphasize the importance of financial responsibilities in a rental agreement. The Security Deposit Agreement ensures that tenants understand their obligations regarding the deposit, just as the Reiwa form informs them about the financial aspects of securing a rental.

Lastly, the Move-In Checklist is comparable to the Reiwa Tenancy Application Form in that it addresses the condition of the property at the start of the tenancy. This checklist allows tenants to document any existing issues with the property before moving in. Like the Reiwa form, it aims to protect both the tenant and the landlord by ensuring transparency about the property's condition, which can help prevent disputes later on.

Dos and Don'ts

When filling out the Reiwa Tenancy Application form, there are several important dos and don'ts to keep in mind. Here’s a straightforward list to guide you.

  • Do ensure all information is accurate and complete. Providing false or misleading information can jeopardize your application.
  • Do clearly state any special conditions you may have, such as pet ownership. This helps the Lessor understand your needs.
  • Do submit the application along with any required fees promptly. Delays can affect your chances of securing the tenancy.
  • Do read the entire application thoroughly before signing. Understanding the terms is crucial.
  • Don't leave any sections blank unless instructed. Incomplete applications may be rejected.
  • Don't ignore the importance of your references. Choose individuals who can vouch for your reliability as a tenant.
  • Don't forget to provide accurate contact details. The Property Manager needs to reach you for follow-ups.
  • Don't assume that submitting the application guarantees approval. The Lessor will evaluate all applicants carefully.

Misconceptions

Here are ten common misconceptions about the Reiwa Tenancy Application form, along with clarifications to help you understand the process better:

  1. Misconception 1: The application form is the same as the tenancy agreement.
  2. This is not true. The Reiwa Tenancy Application form is merely a request to enter into a residential tenancy agreement. It collects information to assess your suitability as a tenant.

  3. Misconception 2: Submitting the application guarantees you will get the property.
  4. Submitting an application does not guarantee approval. The landlord or property manager evaluates all applications to find the most suitable tenant.

  5. Misconception 3: You can skip providing personal information.
  6. Providing accurate personal information is essential. It helps the landlord or property manager verify your identity and assess your application effectively.

  7. Misconception 4: You must pay an option fee for every application.
  8. The option fee is only required if specified in the application. Not all applications require this fee.

  9. Misconception 5: The landlord must accept all special conditions you propose.
  10. This is incorrect. The landlord is not obligated to accept any special conditions you request in your application.

  11. Misconception 6: You can apply for a tenancy without inspecting the premises.
  12. It is advisable to inspect the property before applying. By signing the application, you acknowledge acceptance of the premises' condition as seen during the inspection.

  13. Misconception 7: All fees and bonds are refundable.
  14. While some fees, like the option fee, may be refundable if you are not successful, others, such as the security bond, are typically held until the end of the tenancy.

  15. Misconception 8: The application process is the same for all properties.
  16. Each property may have different requirements and processes. Always check with the property manager for specific instructions.

  17. Misconception 9: You can submit your application without any supporting documents.
  18. Supporting documents are often necessary to verify your identity and financial status. Be prepared to provide them when requested.

  19. Misconception 10: Once you submit the application, you cannot change your mind.

  • Understand the Fees: Be aware of the various fees required, such as the security bond, pet bond, and initial rent payment. These fees can add up, so plan accordingly.
  • Know the Process: After submitting your application, if you are successful, you will receive a proposed Residential Tenancy Agreement. You must sign this agreement and comply with its terms to secure your tenancy.
  • Be Prepared for Background Checks: The property manager may conduct checks using residential tenancy databases to assess your rental history. Be honest in your application to avoid complications.
