The Oregon Modest Means Program is designed to assist moderate-income individuals in accessing affordable legal services. This program caters to those who earn too much to qualify for traditional legal aid yet cannot afford standard legal fees. To participate, individuals must complete the Modest Means Program application form, which requires essential personal and financial information, including income, assets, and details about the legal matter. The application process is straightforward but requires careful attention to detail; incomplete submissions will not be processed. Once the application is submitted, applicants may be contacted for further verification and, if eligible, will receive a referral to a participating lawyer. The types of legal matters covered include specific family law issues, criminal defense, landlord/tenant disputes, and foreclosure cases. Importantly, applicants should be aware that the program operates with reduced hourly rates, which vary based on individual financial circumstances, and an initial consultation fee. Understanding the eligibility criteria and the limited availability of participating lawyers is crucial for those seeking assistance through this program.

The program is intended to help those who earn too much to qualify for legal aid, but who cannot afford traditional legal fees. Modest Means lawyers have agreed to charge reduced rates for legal work provided to clients referred to them through the program. There is no grant, fund or subsidy that makes up the difference between the lawyers’ regular rates and the Modest Means Program rates. The lawyers DJUHHWRFKDUJHUHGXFHG rates because they believe in the mission of this program and want to help.

Types of Matters: Modest Means lawyers only handle certain kinds of family law, crim- inal defense, landlord/tenant and foreclosure matters. If the specific area of law with which you need help is not listed on the application, then it is not part of the program.

To apply, you must complete the application form and return it to us by fax, mail, or email ([email protected] ONLY). Eligibility: Eligibility is based on the type and location of your legal matter, your in- come and assets, your location, and availability of participating lawyers in your area. It is important to understand there are a limited number of lawyers in the program, and there may not be a Modest Means lawyer in your county. We cannot guarantee that we will have a lawyer for you even if you pre-qualify. Your Questions, Answered

What is the Oregon Modest Means Program?

The Oregon Modest Means Program is designed to help individuals and families in Oregon who have moderate incomes. If you earn too much to qualify for free legal aid but still find traditional legal fees too high, this program can connect you with lawyers who offer reduced rates. These lawyers volunteer to participate because they believe in helping people access legal services.

How do I apply for the Modest Means Program?

To apply, you need to fill out the application form completely and return it via fax, mail, or email. You can download the form from the Oregon State Bar's website or request a copy by calling the provided phone numbers. Make sure to sign and date your application, as it will not be processed if incomplete. After submission, most applications are reviewed within one business day. If you provide an email address, keep an eye on your inbox for updates or questions about your application.

What types of legal matters does the program cover?

The Modest Means Program primarily addresses specific areas of law, including family law, criminal defense, landlord/tenant issues, and foreclosure matters. If your legal issue falls outside these categories, it will not be eligible for assistance through this program. Be sure to check the application for the complete list of matters covered.

What are the costs associated with using a Modest Means lawyer?

After your initial consultation, which costs no more than $35, the hourly rates for ongoing legal services will be capped at $60, $80, or $100, depending on your income and assets. You will also need to pay a retainer upfront, which the lawyer will determine based on the expected work for your case. Additionally, you will be responsible for any court fees and other direct costs. Keep in mind that this program is not free; it is designed for those who can afford some legal fees.

Common mistakes

  1. Incomplete Information: Many applicants fail to provide all necessary details in the application form. Missing information can lead to delays or outright rejection. Ensure that every section is filled out completely.

  2. Failure to Sign and Date: Omitting a signature or date is a common mistake. The application will not be processed without these essential elements. Always double-check that you have signed and dated your form.

  3. Ignoring Eligibility Criteria: Some applicants do not fully understand the eligibility requirements. If your legal matter is not listed or if both parties do not reside in Oregon, you may not qualify. Review the types of matters carefully.

  4. Submitting Additional Documents: Including extra documents with the application is a frequent error. The program explicitly states that any additional materials will not be returned. Stick to the application form only.

  5. Not Providing Accurate Income Information: Misreporting income can disqualify you from the program. Ensure that you report your gross income accurately, including all sources. This is crucial for determining eligibility.

  6. Neglecting to Check Email: After submission, applicants often overlook their email for updates or questions from the program. Providing an email address is important, so be sure to monitor it for any communications regarding your application.

Documents used along the form

The Oregon Modest Means Program is designed to assist individuals with moderate incomes in accessing affordable legal help. When applying for this program, several other forms and documents may be relevant to your situation. Here’s a brief overview of some commonly used forms that might accompany your application.

  • Income Verification Document: This document provides proof of your income. It can include pay stubs, tax returns, or bank statements. Accurate income verification is crucial for determining your eligibility for the Modest Means Program.
  • Asset Disclosure Form: This form outlines your assets, such as property, vehicles, and savings. Understanding your financial situation helps the program assess your ability to pay for legal services.
  • Legal Matter Description: A brief written statement detailing the legal issue you need assistance with. This helps the program identify the appropriate type of legal aid you may require.
  • Identification Proof: A copy of a government-issued ID, such as a driver’s license or passport. This verifies your identity and ensures that all information provided is accurate.
  • Previous Legal Correspondence: Any relevant documents from prior legal consultations or communications. This may include letters from other attorneys or court documents that relate to your case.

These documents help streamline the application process and ensure that you receive the most appropriate legal assistance. Be sure to prepare them carefully to enhance your chances of being referred to a Modest Means lawyer.

Similar forms

The Oregon Modest Means Program form shares similarities with the Legal Aid Application, which serves a similar purpose of connecting individuals with legal assistance. Both documents require applicants to provide detailed personal and financial information to determine eligibility for legal services. However, the Legal Aid Application typically caters to individuals with lower income thresholds, while the Modest Means Program targets those who earn too much to qualify for traditional legal aid yet still struggle to afford standard legal fees. Both applications emphasize the importance of accurately reporting financial status to ensure appropriate assistance.

Another document akin to the Oregon Modest Means Program form is the Pro Bono Services Application. This application is designed for individuals seeking free legal representation from volunteer attorneys. Like the Modest Means Program, it requires applicants to disclose their income and assets. The key difference lies in the nature of the services offered; the Pro Bono Services Application is aimed at those who cannot afford any legal fees, whereas the Modest Means Program provides reduced-rate services for those who can pay a portion of their legal costs.

The Client Intake Form used by many law firms also bears resemblance to the Oregon Modest Means Program form. Both documents collect essential information about the client’s legal issue, financial situation, and personal details. However, the Client Intake Form is typically used to establish a relationship between a lawyer and a potential client, while the Modest Means Program form specifically assesses eligibility for reduced-fee services. The focus on affordability and accessibility in both documents highlights the commitment to serving individuals who may otherwise be unable to access legal assistance.

The Family Law Case Information Sheet is another document similar to the Modest Means Program form. This form is often used in family law cases to gather pertinent information about the parties involved and the nature of the legal matter. While both documents aim to streamline the process of obtaining legal help, the Family Law Case Information Sheet is more focused on case specifics, whereas the Modest Means Program form centers on the applicant’s financial qualifications and eligibility for reduced fees.

Additionally, the Bankruptcy Petition serves as a comparable document, particularly for individuals seeking legal assistance in financial distress. Both the Bankruptcy Petition and the Modest Means Program form require detailed financial disclosures. However, the Bankruptcy Petition is specifically tailored for those seeking relief from debts through bankruptcy, while the Modest Means Program is broader, encompassing various legal issues including family law and landlord-tenant matters. Each document aims to facilitate access to legal resources for individuals facing financial challenges.

The Affidavit of Indigency is another document that parallels the Modest Means Program form. This affidavit is often required in court proceedings to establish an individual's inability to pay court costs or legal fees. While the Affidavit of Indigency focuses on proving financial hardship for the purpose of waiving fees, the Modest Means Program form assesses eligibility for reduced-cost legal services. Both documents reflect the legal system's acknowledgment of the financial barriers many individuals face when seeking legal help.

Lastly, the Income Verification Form shares similarities with the Oregon Modest Means Program form. This document is often required by various assistance programs to confirm an applicant’s income level. Both forms necessitate the disclosure of financial information to determine eligibility for services. However, the Income Verification Form is typically more focused on verifying income for various assistance programs, while the Modest Means Program form specifically targets individuals seeking affordable legal representation. Each plays a crucial role in ensuring that individuals receive the help they need based on their financial circumstances.
